Acting for the Government of Gibraltar in London’s Technology and Construction Court against a Spanish contractor in relation to a dispute arising out of a £30 million contract (incorporating the FIDIC Yellow Book 1999) concerning design and construction work to the Gibraltar Airport and Frontier Access Road, including a tunnel under the airport runway. Representing an Employer in Gibraltar, as claimant, regarding a claim for over £20 million in relation to defects in the walls and roofs in over 600 flats. The contract was a JCT 81. The arbitration was conducted under the JCT rules with the seat of arbitration in Gibraltar. Proceedings were then commenced in the High Court of England against the parent company of the contractor under a parent company guarantee. The contract value was circa £19 million. |
